SLP Filed by the UOI again the judgement of the Hon'ble High Court Gujarat the matter of Mohit Mineral's Private Limited Vs. UOI has been dismissed by the Hon'ble Apex court. Hon'ble Gujarat High Court had held levy of IGST on ocean freight in a CIF import transaction to be ultra vires the IGST Act,2017. Hon'ble Supreme Court has also held that recommendation of GST council under Article 279A is only recommendatory and not binding. In my view this may now open a Pandora's box.
